The Rules of Membership/Function Room Hire

1. General

Rainhill Club and Sports Lounge Ltd (hereinafter “the Club”) shall operate a Private Members’ Club which part of the designated Club shall be limited to Members only (or bona fide guests of members) and a further part of the Club shall be for Members and non-members.  A copy of these terms are published on our web site www.rainhillclub.co.uk or available for inspection at the Concert Room Bar.

2. Club Premises

The Club premises situated at Warburton Hey, Rainhill, Prescot, Liverpool L35 4LF that shall be used by Members consist of three main areas, namely, The Concert Hall (strictly Members’ only or bona fide guests of members); the Sports Lounge and the Games Room.  Members shall have the use of these rooms on such terms as shall from time to time be agreed by the Club.

3. Licensed Activities

The Club is licensed to conduct specific activities on the premises. These activities will take place at the discretion and with the agreement of the Club and at such times as the Club shall determine.

The Club is required to take steps to promote the four licensing objectives:

  • The prevention of crime and disorder
  • The protection of children from harm
  • Public Safety
  • The prevention of public nuisance

Intoxicating liquor may be sold to persons attending the Club premises for social, sporting or other functions organised or authorised by the Club, but no function shall be permitted to which admission may be obtained by payment of money at the door, whether for a ticket or otherwise. The hours for the supply of excisable liquors shall be determined by the Club and shall be displayed in the bar area and or the Club’s web site www.rainhillclub.co.uk.  The opening times of the public rooms in the Club shall be as determined by the Club.  The sale, supply, or consumption of alcohol anywhere on the premises to, or by, anyone under the age of 18 years is prohibited.  However, an exception is provided for individuals aged 16 or 17 years, where the alcohol is beer, wine, or cider, to be consumed at a table meal, and where it has been purchased by an adult, and provided they are accompanied by an adult aged 18 years or over. Children aged under 16 years may only enter the bar area if they are accompanied by an adult aged 18 years or over.

The Club shall be cleared of members and their guests and closed 30 minutes after the conclusion of the last licensed activity. No supply of alcohol for consumption off the premises shall take place except to a member in person. Alcohol will not be supplied in open containers.  All members and guests must respect the needs of local residents and leave the premises and area in a quiet and orderly manner.

4. Members and Guests

Any person shall become a member upon payment of an annual membership fee the level of such fee shall be determined by the Club from time to time.  The member must complete a membership form and or provide sufficient detail identify the Member by name, address, telephone and or email contact.

Upon supplying the appropriate personal information and payment of the annual membership fee the member will be issued with a membership card.  Membership is renewed annually. A member may not be allowed entry to the Club without production of a membership card. A replacement membership card will issued upon payment of an appropriate fee. Persons other than members may be admitted to the premises and may order and pay for intoxicating liquor from the bar for themselves and their guests for consumption on the premises only, provided always:  That such persons shall be bona fide guest of a paid up member; or that such persons are attending bona fide pre-arranged events and functions being held at the Club and under such conditions as the Committee shall determine.

5. Member Benefits

All paid up members shall have the benefit of:

(1)     Attending the Function Room at no or reduced admission fee on the door usually held on a Saturday and or Sunday evening.

(2)     Inviting up to 6 paying guests into the function room.

(3)     Priority reservations for any of the Club’s special events such new New Year’s Eve and Boxing Day celebrations.

(4)     Entitled to special offers that may be available from time to time.

(5)     Use of snooker, darts and pool tables upon paying appropriate fees.

(6)     Free initial legal advice from the Club’s main sponsors R James Hutcheon Solicitors subject to their terms and conditions.

6. Live Acts and DJ Entertainment

The Club shall use its best endeavours to uphold the traditional Live Acts and or DJ entertainment held in the Function Room on Saturday and Sunday evenings.  However the Club shall not be responsible to any member or guest where no such event occurs either by a decision of the Club or an event beyond the control of the Club.  If a member or guest has paid an admission fee that fee will be refunded by the Club providing that the member or guest requires a refund on the night of the cancelled event and the guest has suitably signed the guest book.

7. Smoking & Open Flames:

Neither smoking nor open flames are permitted in the Club at any time.   Any Member or guest of Member’s who wilfully or recklessly sets fire to any part of the Club will face expulsion and be reported to the appropriate authority.  Civil and Criminal prosecution will be considered

8. Disputes:

A dispute must firstly be brought to a member of staff who shall deal with the dispute at first hand.  If the matter cannot be resolved it will be brought to the attention of the acting Manager within a reasonable period of time.  The Manager will endeavour to resolve the dispute within 14 days of the dispute arising.  The Manager’s decision is final and there is no appeal.

9. Limitation Members Entering the Club
For reasons of public and fire safety, and from time to time, it may be necessary to limit the number of persons (including staff and entertainers) allowed at the premises. These limits will be determined by the Club and will not exceed maximum premises occupancy.

10. Commissions and Fees

No person or member shall at any time be entitled to receive at the expense of the Club or of any members thereof any commission percentage or similar payment on, or with reference to, purchases of intoxicating liquor by the Club; nor shall any person directly or indirectly derive any pecuniary benefit from the supply of intoxicating liquor by, or on behalf of, the Club to members or guests, apart from any benefit accruing to the Club as a whole and apart also from any benefit which a person derives indirectly by reasons of the supply giving rise to, or contributing to, a general gain from the carrying on of the Club.

11. Liability of Members/Guest

Any member who shall wilfully damage any property of the Club shall make good the same to the satisfaction of the Club, and any such damage caused by a guest or visitor shall be made good by the member introducing that guest or visitor.

12. Food & Beverage

No member shall consume on the Club premises any food or beverage not purchased on the Club premises unless prior permission has been obtained from the Club or the person appointed by the Club for the purpose.

13. General

The Club shall be closed at certain times of the year and for such periods as the Club shall determine.
These rules may be altered or repealed, or new rules may be made at any time without prior notice.  Any interpretations of these rules and every question to which such rules do not apply shall be determined by the Club whose decision shall be final and conclusive.

14. Media/Publicity

Media coverage of private or corporate events is not permitted.

15. Liability:

The Club is not liable for any damage or loss to any member howsoever caused.

FUNCTION ROOM – TERMS OF HIRE

Private parties shall be permitted in the Club and under such conditions as shall from time to time be determined by the Club.  Members or non-members (hereinafter “the Applicant”) arranging parties shall purchase their supplies of intoxicating liquor from the Bar. The following rules shall apply to the letting of the Function Room and or the Sports Lounge:

Hire of the Function Room:

The Function room will be hired out by the Club if the Applicant confirms that not less than 50 people shall be attending.  Less than 50 people attending will result in a forfeit of the paid deposit.  The function room shall only be available up to a maximum of 200 guests of the Applicant.

Hire of the Sports Lounge:

The Club will hire out the Sports Lounge, if the Applicant confirms that not more than 60 people shall be attending.

1. The room must be booked in the name of the Applicant.

2. The Club will take bookings on a first come first serve basis (when deposit is paid).

3. No booking shall be confirmed without a formal application form being completed and signed by the applicant together with a cash deposit.

4. There are no refunds once the deposit has been accepted under any circumstances.

5. In the event that the hire is cancelled the Club shall retain the deposit.

6. The Applicant is responsible for all losses and damage to the Club’s property, fixtures, fittings and building.

7. The Applicant must be on the Club’s premises at all times and shall not leave the Club until all guest have left the building.

8. All equipment brought to the Club must be removed from the building at the end of the event.

9. All proposed decorations must be approved by the Club and those deemed inappropriate or dangerous will be disallowed.  Under no circumstances will drawing pins, cellotape or any other material shall be used that could damage any surface of the Club.

10. At the end of the event, the Applicant must consult with the head bar staff regarding any breakages and damage to the Club’s premises and sign the Deposit Form to either confirm refund of the deposit paid in full or part or to forfeit the deposit together with a record of damage or loss to the Club.  If no form is signed on the evening by the Applicant the Club will inform the Applicant accordingly.

11. The Applicant or any of the Applicant’s guests shall not consume on the Club premises any food or beverage not purchased on the Club premises unless prior permission has been obtained from the Club or the person appointed by the Club for the purpose.

12. Upon hire of the Club, the Applicant shall be responsible for any entertainment including live acts, and DJ’s as the case may be.  The applicant must ensure that any entertainment provided for the event must ensure the pre-designated noise limiter are not exceeded and shall, if so advised by any staff of the Club reduce any noise at such level as shall be deemed appropriate by the Club.

13.  Except at the discretion of the Club all private parties must terminate not later than midnight, and no excisable liquors shall be sold, supplied, or consumed except during specified hours. Music shall go on no later than 23:30.

14. The Club reserves the right to shut down an event at any time. This may occur if the applicant has misrepresented the type of the event and it is one that the Club would ordinarily deny, or if general behaviour becomes inappropriate and presents a danger to the Club, staff or occupants.

15. Betting, gambling of any description or any illegal activity on the Club premises shall be strictly prohibited.

16.  The Applicant and guests must respect the needs of local residents and leave the premises and area in a quiet and orderly manner.  The Applicant and any guest of the applicant who breaches this provision resulting in a complaint to the Club which results in any civil or criminal prosecution will indemnify the Club against any damage or loss.
